Welcome to Orbit Fasting! These Terms of Service ("Terms") govern your access to and use of the Orbit Fasting mobile application and any related services (collectively, the "Service" or "App"). The Service is provided by Fast Orbit Apps ("we," "us," or "our"). By downloading or using Orbit Fasting, you agree to be bound by these Terms, as well as our Privacy Policy (which is incorporated by reference). If you do not agree with these Terms or the Privacy Policy, you must not use the App.
Please read these Terms carefully before using our Service. They contain important information about your rights and obligations, including limitations of liability and disclaimers. If you have any questions about these Terms, contact us at fastorbitapps@gmail.com.
Age Requirements: You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an account and use Orbit Fasting. If you are between 13 and 17 years old, you may use the App only with the involvement and consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet the applicable age requirement and have the legal capacity to enter into these Terms. We reserve the right to ask for proof of age or consent at any stage. Orbit Fasting is not intended for children under 13, and we do not knowingly allow such individuals to use the Service (see our Privacy Policy's Children's Privacy section).
Account Creation: To get the most out of Orbit Fasting, you may create a personal account. You can sign up by providing a valid email and creating a password, or by using Sign in with Apple. You agree to provide accurate, current, and complete information during registration and at all other times when you use the App. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. Keep your password secure and do not share it with others. If you believe someone has gained unauthorized access to your account, notify us immediately.
We grant you a personal, non-transferable, revocable license to use the Orbit Fasting App in accordance with these Terms. This account and license are for your own personal use. You agree not to create an account using a false identity or information, or on behalf of someone other than yourself. You may not create multiple accounts for disruptive or abusive purposes. We reserve the right to refuse registration or cancel an account if we suspect any information is false or the account is being used in violation of these Terms.
Orbit Fasting offers optional premium features through auto-renewing subscription plans. By purchasing a subscription, you gain access to additional content and features that enhance your fasting tracking experience. We currently offer two subscription tiers: Monthly and Yearly. The Yearly subscription includes a free trial period of 3 days for new subscribers. The following terms apply to subscriptions:
By purchasing a subscription, you authorize Apple to charge your account for the subscription fees on a recurring basis until you cancel. If your payment cannot be processed (e.g., due to an expired credit card on your Apple account), Apple may cancel the subscription and you may lose access to premium features at the end of the current billing cycle.
Permitted Use: Orbit Fasting is provided for your personal and non-commercial use to help track and manage your fasting routines. You agree to use the App only for its intended purpose and in compliance with all applicable laws and regulations. As a condition of using the Service, you agree not to engage in any of the following prohibited activities:
Violation of any of the above may result in immediate termination or suspension of your account and access to the Service, as detailed in Section 7 (Termination). We also reserve the right to take appropriate legal action if necessary. We trust you to use Orbit Fasting responsibly and thank you for respecting these guidelines.
Ownership of Your Data: Orbit Fasting allows you to input and store your personal fasting data and profile information ("User Content"). You retain all rights to the User Content that you create and submit to the App. We do not claim ownership of your fasting logs, personal metrics, or profile details. By using the App, you grant us a limited license to use, display, and process your User Content solely for the purpose of providing the Service (for example, to display your data back to you, to run analytics internally, or to back up your data). This license is worldwide, non-exclusive, royalty-free, and limited to so long as you choose to store that content with us. We do not use your personal data or content for any advertising or sell it to third parties, as detailed in our Privacy Policy.
Feedback: If you choose to provide suggestions, ideas, or other feedback to us about the App ("Feedback"), you agree that we can use and share such Feedback for any purpose, without compensation to you. Feedback is entirely voluntary, but we appreciate it as it helps us improve Orbit Fasting. Please do not submit Feedback that you consider confidential or proprietary, as we may use it without obligation.
Our App and Content: The Orbit Fasting App (including all software, code, design, text, graphics, logos, and other content provided by us) is protected by copyright, trademark, and other intellectual property laws. All rights, title, and interest in and to the Service and its content remain with Fast Orbit Apps (and its licensors, if any). We grant you a limited, revocable license to use the App for its intended purpose of personal fasting tracking, but this license does not transfer any ownership of our intellectual property to you. You must not use our name, logos, or any of our trademarks without our prior written consent.
Restrictions: Unless expressly permitted by us, you agree not to: (a) copy, distribute, or create derivative works based on the App or any part of it; (b) publicly perform or display any part of the Service; (c) modify or alter the App's source or object code; (d) remove or obscure any copyright, trademark, or other proprietary notices on the App; or (e) use any of our content outside the App for any commercial purpose. If you violate these restrictions, we may terminate your right to use the Service and pursue legal remedies. All rights not explicitly granted in these Terms are reserved by us.
Third-Party Materials: The App may include or interface with certain third-party software or libraries (for example, open-source components) which remain the intellectual property of their respective owners. Use of such materials may be subject to additional license terms. We also may provide links or integrations to third-party resources (such as a link to a fasting knowledge article or a social media page). We do not claim ownership of any third-party content that we do not produce. Your interactions with third-party content are governed by their terms, not ours, and we are not responsible for it.
Not Medical Advice: Orbit Fasting is not a medical or healthcare service. The App and its content are provided for informational and tracking purposes only, to help you monitor your fasting habits. It is not a substitute for professional medical advice, diagnosis, or treatment. We are not medical professionals, and the App does not give medical or health advice. Always seek the advice of your physician or another qualified healthcare provider before starting, stopping, or changing any dietary or fasting routine. Especially if you have any medical condition (such as diabetes, blood pressure issues, eating disorders, or any other health concern) or are on medication, you should consult a doctor before using this App to guide your fasting. Never disregard professional medical advice or delay seeking it because of something you have read in the App.
Use at Your Own Risk: You understand and agree that any decisions you make regarding fasting or nutrition are made at your own risk. Fasting can have different effects on individuals, and what works for one person may not be safe for another. Orbit Fasting may provide general information (like tips or milestone messages), but it cannot account for personal circumstances and is not tailored to your specific health needs. If you experience any adverse symptoms (such as dizziness, fainting, extreme hunger, or any health issues) while using the App or following a fasting regimen, you should stop fasting and seek medical attention. You are solely responsible for managing your health and well-being.
We explicitly disclaim any liability for any injury, illness, or damages that may result from your use of the App or from you relying on information provided by the App. By using Orbit Fasting, you acknowledge these risks and agree that we are not responsible for any health problems that may result from fasting practices, even if the App was used as a tool during those practices. Always listen to your body and use common sense when interpreting your fasting data.
Your Right to Terminate: You may stop using Orbit Fasting at any time. You also have the option to delete your account (via the in-app deletion feature or by contacting us). Termination of your account will be handled according to our Privacy Policy (your data will be deleted or anonymized as described there). If you cancel a subscription or delete the app without deleting your account, your profile and data may remain on our servers until you explicitly delete the account or we purge it according to our retention policy.
Our Right to Terminate or Suspend: We reserve the right to suspend or terminate your access to the Service (in whole or in part) at our discretion, for any valid reason, including if we reasonably suspect that you have violated these Terms or are misusing the App. For example, if you hack the app, engage in fraudulent or illegal activity, or compromise the experience or safety of others, we may disable your account. In most cases of minor violations, we will provide you with a warning and an opportunity to correct the issue. However, for serious or repeated violations, suspension or termination may be immediate and without prior notice. We are not liable to you for any suspension or termination of your account or access to the Service in accordance with these Terms.
If we terminate your account, your right to use the Service will cease immediately. You must delete any downloaded or cached copies of the App from your devices. The provisions in these Terms that by their nature should survive termination (such as intellectual property rights, disclaimers of warranties, limitation of liability, and dispute terms) will remain in effect.
Orbit Fasting is provided on an "as is" and "as available" basis. While we endeavor to provide a great service, we make no warranty or guarantee that the App will meet your requirements, achieve any intended results, or be available on an uninterrupted, secure, or error-free basis. To the fullest extent permitted by law, we expressly disclaim all warranties and conditions of any kind, whether express or implied, regarding the Service and its content, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
For example, we do not warrant that the data presented (such as fasting timers or calculations) is 100% accurate or that the App will always function without delays or bugs. We do not warrant that any health or wellness outcomes will be achieved by using the App – individual results will vary. You assume all risk for any decisions made based on information provided by the App.
No advice or information (oral or written) obtained from us or through the Service shall create any warranty not expressly stated in these Terms. You understand that downloading or using the App is at your own discretion and risk.
To the maximum extent permitted by law, in no event will Fast Orbit Apps (and its officers, directors, employees, agents, and affiliates) be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of (or inability to use) Orbit Fasting, whether or not we have been advised of the possibility of such damages. This includes, without limitation, any loss of data, loss of content (e.g., if your fasting logs are lost due to an unforeseen bug), loss of goodwill, health issues, or any other intangible losses.
Our total cumulative liability to you for all claims arising from or related to the Service or these Terms will not exceed the amount you have paid to us for the Service in the twelve (12) months immediately preceding the event giving rise to liability (or, if no fees were paid, $0). This means that if you have not purchased a subscription (free user), we have no monetary liability to you for any damages, to the extent allowed by law. If you are a paying subscriber, our liability is limited to the subscription fees you paid in the last year for Orbit Fasting.
Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties, so the above limitations may not fully apply to you. In such cases, our liability will be limited to the greatest extent permitted by applicable law. Nothing in these Terms is intended to exclude or limit liability that cannot be excluded under law (for example, liability for death or personal injury caused by gross negligence or willful misconduct, or statutory liability under product liability laws).
You agree to indemnify, defend, and hold harmless Fast Orbit Apps and its affiliates, and their respective officers, directors, employees, and agents (the "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) that arise out of or relate to: (a) your use of the Orbit Fasting App, (b) your violation of these Terms or of any law or regulation, or (c) your infringement of any rights of any other person or entity in connection with your use of the Service.
For example, if you use the App in violation of the Terms and someone brings a claim against us because of your actions, you will be responsible for any costs or damages we incur as a result. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you (at your expense), and you agree to cooperate with our defense of such claims. You will not settle any claim that affects the Indemnified Parties without our prior written approval.
These Terms and your use of Orbit Fasting will be governed by and construed in accordance with the laws of Ukraine, excluding its conflict of law rules. If you are a consumer in the European Union or another jurisdiction with mandatory consumer protections, this choice of law does not deprive you of any protections you have under your local law.
Jurisdiction: In the event of any dispute or claim arising out of or relating to these Terms or the Service, you and Fast Orbit Apps agree to submit to the personal and exclusive jurisdiction of the courts located in Ukraine for the purpose of resolving any such dispute. (If you reside outside of that jurisdiction, you agree that any legal action or proceeding shall be brought in the courts of our jurisdiction, and you consent to that venue and jurisdiction.) Notwithstanding this, you agree that we shall still be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.
Dispute Resolution; No Class Actions: We encourage you to contact us first if you have any issues with the App, as most problems can be resolved quickly and to our users' satisfaction. If we cannot resolve a dispute informally, and unless prohibited by applicable law, you and we agree that any dispute will be resolved on an individual basis, and not as part of any class or representative action. You and Fast Orbit Apps waive any right to participate in a class-action lawsuit or class-wide arbitration against each other.
We may modify or update these Terms of Service from time to time. If we make material changes, we will notify you by posting the revised Terms within the App and updating the "Last updated" date above. We may also notify you via email or in-app message of significant changes. It is your responsibility to review these Terms periodically. Any modifications will become effective upon posting unless otherwise stated. If you continue to use Orbit Fasting after the new Terms take effect, you will be deemed to have accepted the changes. If you do not agree to the revised Terms, you should stop using the App and, if necessary, cancel any subscriptions and delete your account.
Entire Agreement: These Terms, together with the Privacy Policy and any additional guidelines or policies we provide in the App, constitute the entire agreement between you and Fast Orbit Apps regarding the Service and supersede any prior agreements or understandings (oral or written) relating to the same subject matter.
Severability: If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect.
No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Fast Orbit Apps.
Assignment: You may not assign or transfer your rights or obligations under these Terms to any other person without our prior written consent. We may assign or transfer our rights and obligations under these Terms freely to an affiliate or in connection with a merger, acquisition, or sale of assets, or by operation of law. These Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
Third-Party Rights: These Terms do not create any third-party beneficiary rights. No person other than you and Fast Orbit Apps (and permissible assigns) shall have any rights to enforce these Terms.
Headings: Section headings in these Terms are for convenience only and have no legal or contractual effect.
